Having considered the agreement, it seems that there is still a threat of a lawsuit by Dvorak. My theory is that S&G were informed that if they did not accept the agreement that Dvorak would indeed sue and that the IHL would terminate them immediately. The facts are not very important to Thames, the IHL or any other leaders in this state.

I would have preferred that the hearings continue for 2 days and that the public hear both sides. However it would be naive to think that the IHL would side with the professors. If S&G believed that they would have received fair treatment from the IHL, I think they would have continued. Compound the certainty of termination with the certainty of legal costs fighting a lawsuit for the next several years and I understand why they agreed to settle. I am frustrated by the agreement but I realize the gravity of the situation for S&G.

The losers are clearly the University which is clearly not SFT. The University is the faculty and the students. The faculty have effectively lost tenure and the students will lose due to the loss of faculty.

I wish I felt that SFT would be leaving this summer, but the agreement stinks so bad that I believe the state is trying to teach the faculty a lesson. Perhaps SFT can continue to make stupid decisions and he will eventually go, but I expect that he will be given his complete term.

You may be right about the rest...and I'm sure the threat of having to fight a meritless lawsuit filed by Angie Dvorak did loom large.


But speaking from a purely expedient standpoint, the IHL Board must have some expectations about Thames' behavior. At a minimum, that he will not keep making them look bad. And that they will not have to constantly intervene in USM affairs, on account of his foolish actions.  The Board does not want to manage the day-to-day operations of USM.


The problem for Thames and his supporters is that he cannot be expected to fulfill the Board's (woefully limited) expectations of him.


Particularly not if he is being constantly challenged, and his reactions to the challenges are constantly being covered in the media.


He deserves to be kept under relentless pressure...and USM faculty, students, and sympathizers can keep him under it, until he becomes too great a load for the Board to bear.

You can bet on it -- one of the excellent things to come out of the hearings were the specific techniques of survelliance and repression this administration was using. We needed hard evidence -- we now have it. We need to make a case that 1) we cannot work under such conditions 2) those techniques are still in play anbd this administration cannot be trusted 3) intimidation is still being used (Dvorak's comment is a good example) and a threat is hanging over the head of every faculty member whose name is on Shelby's enemies list.


No institution can operate successfully without trust and trust is impossible. The fox is still in the henhouse. 


I believe that in the next week several faculty councils will have a lot to say about this.
